Getting Car Insurance in Texas

Here at Infinity Insurance, one of our jobs is to make sure your Texas auto insurance policy aligns with the minimum coverages required by the Texas Department of Insurance. The list below shows the minimum requirements, but each policy can be customized to suit your needs. Some drivers opt for more coverage to ensure they are adequately covered in the event of an accident. The minimum required auto insurance coverage includes:

  • Bodily Injury Liability: $30,000 per person and $60,000 per accident
  • Property Damage Liability: $25,000
  • Personal Injury Protection (PIP): $2,500 (unless you reject this coverage)
  • Uninsured Motorist Bodily Injury: $30,000 per person and $60,000 per accident (unless you reject this coverage)
  • Uninsured Motorist Property Damage: $25,000 and a $250 deductible (unless you reject this coverage)

What Determines My Car Insurance Rates in Texas?

There a several factors that determine your Texas auto insurance rates. Maintaining a clean driver’s license is often one of the main factors in determining insurance prices. Some additional factors include:

  • Your driving history
  • Vehicle make/model/year
  • Your location
  • Number of people in your household (of driving age)

Car accidents in Texas, fault or no-fault?

Texas is considered an at-fault state, meaning before damages can be awarded one of the drivers must be found at fault. The party considered "at-fault" will be responsible for paying any medical expenses, loss of wages, or repair cost associated with the car accident.

In order for an injured party to collect the full damages owed to them, they must be proven to be less than 50% responsible for the accident. This is what's called modified comparative negligence, once the proper fault is assigned the injured driver can be paid the damages owed.

In some cases, the amount owed in damages to the injured party is more than the at-fault driver's insurance coverage. In these cases, the injured party could sue the at-fault driver's car insurance company to recover the difference or they may elect to use an Uninsured Motorist or Underinsured Motorist policy to cover the gap. UM, or UIM is a form of liability insurance that can help whenever the at-fault drivers' insurance isn't enough to cover damages.
