Is Georgia Considered a Fault or No-Fault Car Accident State?

Georgia is what's considered a 'fault' state. These are states where the insurance company of the at-fault party is responsible for covering any injury cost, loss of wages or repairs associated with an auto accident.

In addition to being a fault state, Georgia also follows the comparative negligence guidelines which proportionately assign blame to the motorists based on how responsible they were for causing the accident. This ensures that the injured party receives appropriate compensation, while also being held accountable for their role in the collision. Before receiving any damages, Georgia requires that the injured party be found less than 50% responsible for the collision.

In both cases, the insurers are responsible for paying any damages. In the event, one of the drivers is uninsured or lacks sufficient coverage having an uninsured motorist policy can help cover any of the gaps in coverage.
