How no-fault insurance works
After an accident, each driver typically files no-fault claims with their insurance company. If it is a covered incident, no-fault coverage or PIP insurance typically helps to pay for financial losses related to the accident, regardless of who’s at fault. PIP insurance may help cover:
- Medical bills for the policyholder
- Medical bills for the policyholder’s passengers in certain circumstances
- Lost wages due to accident-related injuries (up to a predetermined dollar amount)
- Funeral expenses
Personal injury protection insurance doesn’t cover every claim. This coverage usually doesn’t pay for:
- Damage to your vehicle or a third-party's vehicle
- Injuries to a third-party from a collision who’s not your passengers
States that require no-fault insurance
Currently, 12 states require no-fault or PIP insurance:

- Florida
- Hawaii
- Kansas
- Massachusetts
- Michigan
- Minnesota
- New Jersey
- New York
- North Dakota
- Oregon
- Utah
States like Kentucky and New Jersey are “choice no-fault” states, where drivers can choose between no-fault insurance and traditional liability coverage. In Pennsylvania, it’s required for drivers to have either PIP or medical payments coverage with a minimum of $5,000 per person, per accident.
